Have you decided to invest in your savings in a site, knowing that investing in a site is one of the difficult investment decisions? However, here are some vital points that one has to consider before buying a site in order to secure their purchase.

1. The first and foremost point that one must check while buying a site is the land use, whether it is an Agricultural Land or a land that can be used for residential purpose. If it is an Agricultural Land check whether the land is converted into non-agricultural land and got all approvals from the concerned authorities. And, there are various restrictions to buy and sell agricultural land.
2. Check for the site layout, which is approved by the Bangalore Development Authority (BDA) based on few factors like road width, residential area, civic amenities, and other amenities.
3. Verify, whether the site is approved by the regulating authority Bangalore Metropolitan Regional Development Authority (BMRDA).
4. Check for the General Power of Attorney (GPA) or the right of the seller over the property. Look for the title deed and confirm the land is registered in the name of the seller and that person has full right to sell the land and don’t forget to examine the sale deed from a well-known attorney.
5. Enquire whether the land is associated with any legal issues and ask for the Encumbrance Certificate (EC) in the sub registrar’s office where the sale deed was registered. Encumbrance Certificate will show if the land is free from any legal issues or is involved with any legal concern.
6. Check for the growth in the area and for necessary infrastructure to build your home, right to build public road and other possibility in the land.
7. If any loan is taken on the land by the owner ask the seller to produce ‘release certificate’ from the bank or the lender saying no amount is due.
8. Check whether the land is under joint ownership, then it is wise to get a release certificate or NOC from everyone who is involved in the ownership.
9. It is advised to measure the land by a surveyor before registering it and check the dimensions, area, boundaries, and other matters and make sure that measurements are accurate and is the same is mentioned in the agreement.

TDS Will Not Be Levied For Service Tax with Separate Service Cost on Purchase Property

According to the Central Board of Direct Taxes (CBDT), the new set-up of ‘Tax Deducted at Source’ (TDS),this was implemented on 1st June of 2013 on immovable property that levies the purchaser of an immovable property (other than agricultural land) of cost Rs.50 lakhs or more with a with holding tax at the rate of 1 per cent. As certain misunderstandings rose while paying the TDS, the Central Board of Direct Taxes examined the TDS once again and simplified that TDS need not to be paid, if service tax is shown separately.

To explain in detail about the new judgment in TDS, while buying an immovable property, after negotiating with the seller, if the buyer pays the service tax amount separately and is not included with other costs charged on a resident like the professional services or technical services, then TDS is not necessary to be paid on the service tax part.

For an instance, if a buyer buys an immovable property from a real estate developer or builder that costs around Rs.60 lakhs, then the buyer has pay TDS of 1% on the purchased amount, in case if the buyer gets a separate acknowledgement from the seller for service tax on the property and that costs around 2 lakhs, then the buyer has to pay TDS for only 58 lakhs and not on the total purchased amount.

The imperative point or terms that a buyer should keep in mind is that in order to get exception of TDS for the service tax on immovable property, the buyer should keep a separate document for the service tax on property and should not be included in the total cost of the property, but should ensure that it is mentioned the agreement or contract between the buyer and seller.
